要旨・内容

南部家は幕府の命令により、盛岡藩と八戸藩に分けられた。盛岡藩には分化律があるが、八戸藩にはそのような成分刑法があったかどうかはまだよくわかっていない。八戸藩史料やその他に記載された刑法関係の事例や「被仰出」を整理し、事例の検討を進めていく。第一では失火と刑罰について見ていく。

要旨・内容 (英語)

The Nanbu family was divided into the Morioka clan and the Hachinohe clan by order of the shogunate. The Morioka clan has a separate law, but it is not yet clear whether the Hachinohe clan had such a separate penal code. We will organize the criminal law-related cases and "requested" mentioned in the Hachinohe Domain historical materials and other sources, and proceed with the examination of the cases.
